Terms of use

1. What Change Hands is, and is not

• Change Hands is an online platform where business owners list businesses for sale and buyers find and contact them.
• We are not a business broker, agent, valuer, lawyer, accountant or financial adviser. We do not act for buyers or sellers, negotiate sales, hold deposits or take part in any sale.
• Nothing on the site, including AI-generated content such as reviews, suggested questions, estimates and match scores, is legal, financial, tax or investment advice. Always get your own professional advice before buying or selling.

2. Your account

• You must be at least 18 and able to enter into contracts in Australia.
• Give accurate details and keep your login secure. You are responsible for what happens on your account.
• We may suspend or close accounts that break these terms or that we reasonably believe are misleading, fraudulent or unsafe.

3. Sellers

• You must own the business or be authorised by the owner to sell it.
• Everything you put in a listing, including figures, your SWOT and documents, must be true, complete and not misleading. You are responsible for it, not Change Hands.
• We may review, edit for format, decline, pause or remove listings, including listings our automated checks flag.
• You decide which buyers to approve. Detailed figures are shown only to buyers you approve who sign the confidentiality agreement (NDA).

4. Buyers

• Information you give sellers about yourself, such as funding, deposit and timeframe, must be honest.
• If you sign an NDA you must keep to it. The NDA is an agreement between you and the seller, and the seller can enforce it against you.
• Listings are prepared by sellers and are not checked or verified by us. Do your own due diligence and get professional advice.

5. Things you must not do

• Post false or misleading information, or impersonate anyone.
• Use information from the site to contact a business's staff, customers or suppliers without the seller's permission, or for any purpose other than buying or selling a business.
• Copy, scrape or resell listings or other content, or try to get around the site's security or access controls.
• Use the site for anything unlawful, or to spam or harass other users.

6. Fees

Founding sellers list free for 12 months from the date their listing goes live. After that, the listing stays live for $195 per 6 months. Other plans and prices are shown on our Pricing page. We will tell you before any fee applies to you, and you can choose not to continue.

7. Content and AI features

• You keep ownership of what you upload, and give us permission to host, display and process it (including with AI tools) to run the site.
• AI-generated content (including AI reviews, suggested due-diligence questions, estimates and match scores) is general information only. It is produced automatically from what users enter, is not checked by a person, can be wrong or incomplete, and does not take your circumstances into account.
• AI content is not a valuation and is not a substitute for your own due diligence or for advice from your own accountant, lawyer or other qualified adviser. Check it before relying on it.

8. Liability

• Nothing in these terms excludes rights you have under the Australian Consumer Law that cannot be excluded.
• To the extent the law allows, we are not liable for any loss arising from a listing, a sale or purchase, another user's conduct, or reliance on content on the site, and our total liability to you is limited to resupplying the service or the amount you have paid us in the previous 12 months.

9. Privacy

Our Privacy Policy explains how we handle your personal information.

10. Changes and governing law

• We may update these terms. If changes are significant we will tell you by email or on the site before they take effect.
• These terms are governed by the laws of Queensland, Australia.
